    The CFR states that you cannot claim diabetes due to your exposure in the gulf war. That was a part of the Congress intent when they expanded the law in 2001. Congress had in the intent that diabetes and MS was not to be granted along with other things.

    H Lee Graley, you may need to see what type it is " GERD and now they found stomach Cancer" some cancer can be caused by GERD. Get the opinion of a GI doctor.

    They type II can be claimed if you fit this like what is going on with me. You do need your doctor to agree to. Yes most of the medicines given to a veteran has the side effects of weight gain. You also have to have other things like not able to work out like you once did, (running 4 miles a day) or riding a bike. Have a SC illness that stops this. or other SC illness to like a thyroid problem like I do too. I am one of the very few that was EVACed with all signs of nerve gas exposure but death. The first gulf report has it in the as I was the Operation office under John R. Gingrich that he was talking about in that gulf war task force report.

    Dear Med-PA Desert Storm vet, Many vets are given medications for their illness due to their service that causes the weight gain. You insult it us in that it is a willful part on a vet only that is causing it is as short sighted as those on the nerve gas was not a factor to any veterans.

    Look a a veteran with fibromyalgia, Migraines, bad legs, feet hips & back due to in-service injuries, then puts on 50 pounds.
    The vet does not eat the "fatty diet" you talk about. He eats Veggies, fish and some chicken.

    Well why is he now at the door??
    He worked out hard to not put on the weight in the VA pool, drop a lot but it comes back.
    Not until the medicine changes did it go off. 80 pounds. the weight of when in the EVAC during the war.

    So you are wrong.

    It is not the war, it is the meds they give is at the VA. Look at the side effects. The VA needs to start giving us comp on a secondary to the meds they give us.

    What you need to understand is that the medication you are on to treat PTSD, Depression and chronic pain all can cause Sleep apnea.
    Sleep apnea is not caused by PTSD and thus you cannot file a claim for it being caused by PTSD (secondary to PTSD). It is due to the medication you are taking for PTSD or depression. You also need a doctor nexus to that fact. Some medication do have these known side effects, along with the weight gain. Read the article in ngwrc.org

    central apnea can be caused be neurological problems and also due to medication for pain. If you are on pain meds for a illness or injury that is service related and SC by the VA, you maybe able to get the SA as secondary to that. You would have to have a doctor say that is is at less a 50% / 50 %or better.

    Col Kent the problem was that the research never went to the next step on the sleep study for gulf war veterans. The researchers told the RAC the problem is they cannot get the number of veterans needed for the study for a large scale study. While the VA can look at the number of Desert Storm veterans that are Dx with SA and other DX illness as they were to, they to this date have not. The VA only looks for mental illness problem. When one looks for only one thing they will never see the whole battle field.

    I see a lot of claim that are done wrong. The raters deny the claim for CF or CFS stating it is not in the vets STR, not even looking at the fact it is a presumptive. even when the vet claims it as so.
    The VSO is as much to blame for this as they sign off on the rating and they did not fight this. They should know that it should not have been denied and causing the veteran two to three more years of hold time for a rating that was a no brainer.

    Illness like Fibro and IBS and CFS do not have to even be in your records. if the VARO wants they they are braking the rules. I just did a case in KY that was like this.

    The VA has not even sent out a mailing since 2010 and that one was due to the 20th year since the start of the war. there was a long pause before that one was sent. There has been a lot of changes in the regulations and research found some things. There are new ways to treat some things like FM and CFS too. this information should be sent out in the gulf war letters. Even if the letters was to those on the registry exam. those veterans do tell everyone else.

    You can get on the Gulf war registry at your VA hospital. Sadly most do not know where it is. So ask where the Agent Orange Registry is. Once your there, ask for the Gulf War registry. Make sure they give you the right paper work. They sent me the paper work for Nam. I took it back and it was sent again.

    Some VA's are great at this and the Topeka Kansas one sucks.

    There is no real standard in the registry exam. The data is off. When you ask about the birth problems in it you do not let those of us that did not even try to have kids after the war op out. I had to reply as if I did and there was no problems. Thank you Topeka VA.

    They also said in all of the exams I had no problems. I was given a medical discharge. started having migraines, IBS, upper GI problem, light hotheadedness and nerve problems in the desert as per the records from the EVAC hospital. Been seen there after.
    Why is my rating say YES and the reg say no. the reg exam is a white wash and never should be used for anything. I do remember writing Col. Gingrich on this.

    The one person in KY VARO that even does the training needs to go. He stated he does not like the 3.317 and works to rate or deny them. in the last claim there. he asked for a medical opinion if fibromyalgia was cause in the service. sent to the examiner on jan. 2013. The same for a diagnosed IBS. and would not tuch the secondary of the headaches to FM. Now you think this guy that is training other is reALLY GOING TO HELP ANY ONE. I even still see this in the St. Pete RO on claims under 3.317.

    No matter what you do it will not work until everyone in the VA system is all doing it right. Why do you think you have back logs???
