Don't give up. New information can be submitted. Make sure you show where it started while in the Military and add records showing it is continuing to occur now. Sometimes issues dont flare up until later. Make sure you have documentation to bridge the gap from your military service to the current issue. I am working on issues from 1970 to now. No one can determine when an iliness will manifest itself. The year after DS is just a guideline. If it begin in service and is occuring now it is Service Conected. Resubmit with letter stating you disagree and make sure you send your documentation. Call a VA advocate for assistance.

George: This site has provided me with the closure I've needed. At least it's understood the country & congress doesn't give a damn about the soldier much less the veterans. "Kicked aside" is giving much credit to a citizenry who has displayed ZERO RESPECT for it's freedom keepers.
The only reason this site was put up is to curry the image that the VA will stand by it's future troops.
Look at the funding approvals for the tiltrotor program; then ask why the leading researchers on Gulf War Syndrome have had thier funding yanked.

Ditto to the comments about the VA claim process. It is too much of a headache for many to endure. I stongly believe it was done so to defeat the person submitting the claim. This process is written with the guidance as the tax codes. Well we are simple people with a desire to be taking care of and get what we signed up for. Streamline the process by hiring a staff not to adjudicate but rather file calaims for veterans. You need to have the capabilities to pull up all of his/her records. Stop all of this run around stalling the process it is the VA that is the problem. Consider letting VA do all the leg work them I believe they will have a change of heart and people will start being compensated. Veterans were soldiers who stood tall they worked many day/nights in the col.wet, rainy, and snow. We did'nt go to the doctors when duty called. Soldiers did not want profiles fear of reclassification, and no getting selected for promotions. VA staff simply do not understand they do not even know how to identify a Veterans rank. There is no respect they just want their breaks and paychecks. Too many of my friends have died from service related illnesses they would be here today if VA had taken care of them. It is just another Veterans story. Asks the veteran is the VA taking care of you, 99.1 % will say no. We are losing benefits at so fast. Just recently the VA took our penneys away from our benefit check. This was stealing our money. Just think how much they made and we lost. If we get anything in the form of compensation it is not enough. Soldiers you deserve the best care you can get the compensation for illnesses in most cases want arrive untill you are six feet under.

In case of pre-existing then appeal and file NOD wih presumtion of soundness meaing if I was healthy enough to enter military, Uncle Sam made the mistake if my illness/injuries got worse. I know this for a fact as a guy I went to basic training with was discharged before he eben made it to AIT. Years later I see the same guy (IRR) heading to Saudi. He told me he never went back into military, but was called up years later and low and behold passed the physical to go to Saudi. This is classic case of presumption of soundness failed on Uncle Sam's part.

I agree sleep apnea should be one of the presumptive diseases there are many gulf war vets afflicted with this. We were given gulf war examinations, yet these were the draw down years as many left before any investigative or medical treatment was given. USE THE GULF WAR EXAMS AS EVIDENCE!

Cut out the technical stupidity. Getting denied for a claim because the vet wrote down "Chronic fatigue", instead of "Chronic fatigue Syndrome", is not doing the Vet, or these studies any good.
A lot of us DS vets are rapidly feeling left out by our country. It seems we are lost between 2 wars, and kicked aside by our country.

My initial claim filed in 1993 took 3 years. I was medically separated for a back injury and have 3 star on SWA, Liberation Kuwait from Kuwait and Iraq. They treated the Gulf War symptoms separate from the med board by USMC. Now 20 years later and 11 med boards later I continue to be denied anything for Persian Gulf War exposure. As others have noted, pre existing conditions or non sufficient medical evidence has been the status quo for 20 years.
How about if we get treated the same as the post 9/11 veterans and the Vietnam Veterans?

The C & P process took for ever and although they acknowledged I had issues, they argued some were pre-existing and others were not worse enough to warrant compensation, so my claims were denied. I have yet to appeal.

I, too, was attacked by my examiner claiming to have served in the Gulf War. I asked his TSR and he asked what that was -- I knew right then he never served in the Gulf War. He attacked my asking him his qualification for asking certain questions. I asked him to administer my c & p exam according to Title 38. He actually left the room. Of course in his info ROI he claimed I was hostile and decided not to continue my c & p exam. I was then rescheduled and had the c & p exam given by another person who claimed to dislike the former (this out of the blue) I clammed up and new it was a setup. How on earth are vets going to trust anybody in the government/va when treated like dirt? I'm not going away,so you better hope for something else (VA)

I filed a claim with the VA for Chronic Fatigue Syndrome(Gulf War Illness). The VA said i have 5 of the 6 criteria for the disease. I went to my C@P appointment and they flat out denied me. The C@P doctor said i have Chronic Fatigue but not the syndrome. What?

I also think that sleep apnea should be on the list of presumpative diseases. Many veterans are showing up years later with this condition...and if you look into the 911 attack many people are also diagnosed with this condition and getting the compensation for it, while the military had to fight tooth and nail to get theirs after being around the burning oil fields etc.

THE SAD THING IS WHEN YOU SERVE YOUR COUNTRY AND IT SEEMS TO TURN THEIR BACKS ON YOU IN THE TIME OF NEED. THEY KNOW WHAT THEY DID TO ALL OF THE GULF WAR ERA VETS... THEY REFUSE TO ASSIST US WITH COMPENSATION THAT IS DUE TO US; WE NEED NOW...NOT YEARS FROM NOW

It is sad when a C&P examiner attacks your integrity and character as part of her examination. I have MAJOR issues with the C&P process. Zero accountability and transparency for these examiners.

Don't poison more soldiers with Gadolinium used for MRI scans. See FDA.gov for black box warnings on this toxic metal used for magnets in the scans, that is injected in the vein, symptoms develop later, mimic neuro and skin diseases, related to liver and kidney problems, that no one would ordinarily suspect that the MRI contrast poisoned them months later, the VA plans to do this to the TBI soldiers with fMRI's, functional mri's, more dye, longer exposure. Suffereing. See Nephrogenic systemic fibrosis. My Denver- VA doctor lied to me for the past several years about my decreased renal function. I hate him. I exposed him, too. He deserved it.
