Separation Pay after the Gul War
Was anybody forced out after the Gulf War and collected separation Pay and got rated and now they are taking back that money?
I got forced out after the Gulf War I was in The Marine Corps and I was given $19,202 I filed a claim in March 2010 I was rated at 60% the VA has been withholding $974.00 for 19 months. And I'm still waiting to get paid for my dependant wife so I have not collected anything.

If it was a medical separation pay and you paid taxes on it and later became rated by the VA you will need to fill an amended tax return to recoup the taxes back. There was a court ruling on this.

You were most likely paid separation pay when you left service because of your condition. When the VA pays you, that money must be recouped to prevent double dipping. You can't be paid twice for the condition and you can not receive VA benefits and Military retirement benefits until the 50% VA disability and 20 year retirement mark (concurrent receipt). You can look up concurrent receipt on google. The VA has no say this.

if you was given a medical the VA can only with hold the money for that what you was given it for at the percentage. say you was given 10% for your back. they can only with hold 10% comp rate.
Now if you took the early out that is a different story. The VA by law can with hold the money. you many want to see about them having a reduced repayment due to hardship if that is your case.
